Article 1. Applicability

1.3 The General Terms and Conditions can only be deviated from if this has been agreed in writing. In this case, the other provisions of the General Terms and Conditions remain in full force.

1.4 Any General Terms and Conditions of the customer do not apply unless expressly agreed in writing by Lola's sportswear.

1.5 The internet site of Lola's sportswear focuses on the international market.

1.6 "Customer" is understood to mean: every visitor to the internet site and every natural or legal person who has entered into or will enter into a contract of any nature with Lola's sportswear.

1.7 By using the internet site of Lola's sportswear and/or placing an order, the customer accepts the General Terms and Conditions.

1.8 Lola's sportswear is authorized to engage third parties in the implementation of an agreement with the customer.

Article 2. Offers and conclusion of the agreements

2.1 Offers are valid while stocks last.

2.2 A personalized offer is valid for three (3) weeks, unless a different term is stated in the offer.

2.3 An agreement is concluded when an order confirmation is sent by email to the email address specified by the customer. This agreement can be revoked by Lola's sportswear in case the customer does not comply with the General Terms and Conditions or has fulfilled them in the past. In that case, Lola's sportswear will inform the customer of this within thirty days after receipt of the order.

2.4 The customer and Lola's sportswear expressly agree that a valid agreement is concluded by using electronic forms of communication, as soon as the conditions in Article 2.4 and 2.5 have been met. In particular, the lack of an ordinary signature does not affect the binding force of the offer and its acceptance. The electronic files of Lola's sportswear are, insofar as the law allows, hereby regarded as presumption of evidence.

2.5 Lola's sportswear does not have to take back articles that are on offer, but call them ''returning''.

Article 3. Prices

3.1 All prices are expressed in euros, in accordance with the legal requirements in this regard, and include VAT.

3.2 Special offers are only valid while stocks last.

3.3 If the prices for the products and services offered increase in the period between the order and its execution, the customer can cancel the order or dissolve the agreement within ten days after notification of the price increase by Lola's sportswear.

Article 4. Payment

Article 5. Delivery and delivery time

5.1 The shipping time of your products is approximately 2-3 days. If you have not received your products after this time, please contact our customer service.

5.2 After ordering, confirmation will take place via e-mail to the customer stating the price and invoice number.

5.3 Orders are processed as quickly as possible. Lola's sportswear strives to process orders placed before 2 p.m. on a working day the next working day (if paid in advance, counted from receipt of payment). The latest delivery term is two weeks after receipt of the order, with the exception of advance payments where the latest delivery term is four weeks after receipt of payment. If the final delivery term is not feasible, the consumer can cancel the purchase. Amounts already paid will then be refunded as soon as possible, but within the statutory period.

5.4 If a product that is temporarily out of stock is ordered by the customer, it will be indicated when the product will be available again. Lola's sportswear strives to report delays to the customer by email within one working day.

5.5 Express delivery is possible. In case of urgent delivery, shipping costs will be taken into account. To ensure that you have an urgent delivery, you can always contact customer service.

5.6 Pre orders are possible, the customer receives a 10% pre-discount. The delivery time of a pre order is stated in the product description, this can take up to 4 weeks. You can recognize a pre order by ''*Pre order* behind the size name.

Article 6. Cancellation and return

6.1 There are no costs associated with a cancellation, unless the product has already been shipped or delivered.

6.2 Pre orders can be canceled within 7 days.

6.3 The customer can return a product up to 14 days after receipt without giving reasons. This period of 14 days starts on the day after receipt of the product by or on behalf of the customer. The return costs are not reimbursed. It must therefore be sent within those 14 days before 16:00

6.4 During this period, the customer will handle the product and the packaging with care. He will only unpack and view the product to the extent necessary to assess whether he wishes to keep the product. It is not the intention that the customer also uses the article during this period, so it is really a trial period. If he makes use of his right of withdrawal, he will return the product with all accessories supplied in the original condition and packaging to Lola's Sportswear, in accordance with the instructions provided by Lola's Sportswear. After the returned product has been received, checked and approved by Lola's sportswear, the amount to be refunded will be refunded to the customer's account within 10 working days.

6.5 Returns are only possible upon presentation of the original invoice.

6.6 Items in the sale cannot be returned. A credit voucher with two years validity is possible. Exchange is also possible.

6.7 ''DIY PUSH-UP PADS''  are not possible to Return due to hygiene.

6.8. Swimwear is not taken back due to hygiene.  

Article 7. Guarantee and liability

7.1 Lola's sportswear guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions and/or provisions existing on the date of the agreement. government regulations. 7.3 There can be no guarantee in the following cases:

- if changes have been made in or to the product, including repairs that have not been carried out with the permission of the manufacturer or seller;

- if the original invoice cannot be submitted, has been changed or made illegible;

- if the wear can be considered normal;

- if defects are the result of non-destination or injudicious use;

- if damage is caused by intent, gross negligence or negligent maintenance.

7.4 The customer is obliged to indemnify Lola's sportswear against any claim that third parties may assert against Lola's sportswear in connection with the execution of the agreement, insofar as the law does not prevent the relevant damage and costs from being charged to the customer. come.

Article 8. Complaints procedure

8.1 Lola's sportswear strives to complete all orders to the satisfaction of the customer. In the unlikely event that something goes wrong, the customer can submit a complaint. Article 9. Force majeure

9.2 Force majeure is understood to mean any circumstance beyond its control, as a result of which the fulfillment of its obligations towards the customer is prevented in whole or in part. These circumstances include strikes, fire, business failures, power failures, non-delivery or late delivery by suppliers or other third parties engaged and the lack of any permit to be obtained from the government. Force majeure is also understood to mean: malfunctions in a (telecommunication) network or connection or used communication systems and/or the unavailability of the internet site at any time.

Article 10. Intellectual Property

Article 12. Applicable law and competent court

12.1 All offers and agreements are exclusively governed by Dutch law.

12.2 The applicability of the Vienna Sales Convention is expressly excluded.

Article 13. Cadeaubon
